Question 1:
A LIVING WILL is a document specifying that your doctor
can terminate any life support systems for you in the event that
you are being kept alive solely by those systems. This program
will allow you to write a document that insures that the support
systems won't be terminated unless two doctors have concurred with
the diagnosis.
You should use this document carefully. In many states, a document
such as this one is only viable legally if you have been diagnosed
with a terminal illness at the time it is signed. Thus, if you
wish to have this document generally available, you should check
with your attorney to see what the law is where you live.
Note also that you need to be of sound mind in order for this to be
of any effect. Two witnesses generally should be used so they can
later be called upon to answer questions concerning your mental
state when you signed this.
Question 2:
You need to enter your full name so that it is clear who is
executing this document. If you have been generally known by a
name other than your legal one, then enter your legal name followed
by the letters "aka" and the other name. For example, "John
Patrick McLaughlin aka Sean McLaughlin."
Question 3:
This question is asked so that the right pronouns will be used
throughout the document.
Question 4:
Please enter the City or Town where you live. If you do not live
in a City or Town, enter the description used by the mail service.
Question 5:
Some people do not live in a County or Parish. You need to answer
this question in the affirmative if you do live in one. The next
question will allow you to identify the name of the County or
Parish.
Question 6:
Here, you should enter the name of the County or Parish where you
live. This can be "Butte County" or the "Parish of Province."
Question 7:
Here, the State or Territory where you live should be entered.
This can be done by simply entering "California," or by entering
the "Territory of Puerto Rico."
Question 8:
This is the first of three questions which allow you to identify
the date. The date that this document is written is very
important. You can choose later to have the document automatically
terminate at the end of a certain number of years in which case you
need to enter a starting date.
Question 9:
Here, enter the month when the Living Will is executed.
Question 10:
Here, please enter the year that this Living Will is
executed.
Question 11:
You can have one or two physicians responsible to make the decision
regarding your life-sustaining equipment. Obviously, choosing to
have two physicians make this decision will insure that before
anything is done in this regard there is a second opinion.
Question 12:
It may seem like a good idea now to terminate life sustaining
equipment if you are terminal, but such an idea may not be viable
if you are pregnant. Obviously, at that time you also need to
consider the needs of your unborn child. Answering this question
in the affirmative will ensure that this document is not used
should you be pregnant.
Question 13:
Many states do not allow the use of Living Will such as
this one. However, the likelihood that it will be legal is greatly
increased if at the time it is executed you have been diagnosed as
having a terminal condition and a couple of weeks have passed since
the diagnosis to allow you to think things over.
Question 14:
Please enter the name of the physician who made the diagnosis, for
example, Dr. David Potter, M.D.
Question 15:
Please enter the full address (including the City or Town and the
State or Territory) of the doctor who made the diagnosis that you
have a terminal condition.
Question 16:
In addition to the address of the doctor who you named in answer to
question 14, you can enter his or her phone number.
Question 17:
Please enter the phone number of the doctor you have named in
answer to question 14.
Question 18:
You can specify that this document will automatically terminate
after a certain number of years if you wish. In some states, a
Living Will is automatically terminated after five
years particularly where you were diagnosed with a terminal illness
but have not died. Please check with your local attorney to
understand the law in your State or Territory.
Question 19:
If you have chosen to have this document automatically terminate in
a certain number of years, please enter the number of years here.
Question 20:
You can have the program automatically enter the names of your
witnesses if you know who they will be. Please do not use anyone
as a witness who is otherwise named in the agreement. Also, it is
a good idea not to use family members as witnesses to ensure that
the witnesses are not biased.
Question 21:
Please enter the name of the first witness.
Question 22:
Please enter the name of the second witness.
Question 23:
The questions are now complete. You can go back to any question if
you wish by pressing "escape", or you can continue with the
program. Now that the questions are completed, the program will
allow you to preview the document, write it to a disk file for
editing further or print it. Note that it will be automatically
saved so you can review or print it later.
